Job Application Information

If you apply for a job with us, we may collect names, addresses, phone numbers, your job history, relevant references (including their names, addresses, and e-mail addresses), and any other information you submit to apply for employment with YMX. Such information may be used to evaluate your application for employment; to communicate with you, YMX employees, and third parties; to respond to and comply with requests and legal demands from regulators or other authorities; to monitor and ensure compliance with applicable laws and our internal policies and procedures; and to establish, exercise, or defend our legal rights.

With YMX Affiliates

Affiliated businesses within the YMX family may use your information consistent with this Privacy Policy. Our affiliates may also use your personal information for their own purposes, including marketing.

With Vendors and Service Providers

We may provide personal information to third-parties who assist us in maintaining and providing our Services, such as payment processors, shipping companies, and others. We do not share personal information with vendors or service providers to use for their own marketing purposes or any other purpose other than to provide our Services without your consent and require assurances that they will appropriately protect personal information entrusted to them by us.

With Third Party Sellers and Other Business Partners

When you use our Sites to order merchandise from a third-party seller, we will share your personal information with the third-party seller for the purposes of fulfilling your order, handling related inquiries or forwarding comments concerning your order. 

Google Analytics and Advertising Services

We may use third-party analytics services, such as Google Analytics to understand how customers and others use our Sites. We may use third parties who help us advertise to visitors of our website when they visit other websites. Legal Rights

We will disclose personal information where necessary for the purpose of exercising, establishing, or defending our legal rights or to protect and defend our rights or property, or those of others.

For Legal Requirements and Proceedings

We may disclose information to law enforcement authorities or other government officials to comply with lawful court orders and to comply with other legal obligations. We may also disclose information if we believe is it appropriate in connection with an investigation of suspected illegal activity.

Sale of Our Business or Assets

In the event of a sale or other transfer of ownership of one or more of our locations or other business units to a third party (whether by private sale, through operation of law, as part of a divestiture plan, or otherwise), we will provide personal information and transaction history associated with each such location or business unit to the persons and/or entities assuming control of such location or business unit.

No Use by Children Under the Age of 18

Products that may commonly be used by minors under the age of 18, like textbooks or children’s books, are marketed through the Site and in our stores. However, products, including products for children, may be purchased on our Sites only by adults. Persons under the age of 18 may only review our Sites, and may do so only with the involvement of a parent or guardian.

We do not knowingly collect or solicit personal information from children under the age of 18 or knowingly allow such persons to register for an online account or to place orders or provide personal information through our Sites. If we learn that someone under the age of 18 has provided any personal information through the Sites, we will remove and permanently delete that information as soon as reasonably possible.

If you are a parent or guardian who believes that your minor under the age of 18 has submitted personal information or other information to us without your consent, please contact privacy@yourmediaexchange.com. Once we verify that you are the parent or legal guardian, we will cooperate with you to discuss what, if any, personal information we have collected about your child and how that information may have been shared or used.

We are committed to maintaining the security of personal information. We employ a variety of technical, administrative, and operational security measures commensurate with the sensitivity of the information we maintain to secure and protect the information we receive. Please remember, though, that neither the Internet nor any method of electronic transmission or storage is 100% secure. Advertising and Analytics

We neither have access to, nor does this Privacy Policy govern, the use of cookies or other tracking technologies that may be placed on your computer, mobile phone, or other device you use to access the Services by non-affiliated, third-party ad technology, ad servers, ad networks or any other non-affiliated third parties. Those parties that use these technologies may offer you a way to opt-out of ad targeting and analytics as described below. Nevada Residents

Certain Nevada consumers may opt out of the sale of “personally identifiable information,” which includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online. Please note we will take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request.

Sale of Personal Information

The CCPA sets forth certain obligations for businesses that sell personal information. We do not sell your personal information, nor have we done so in the last twelve months. We do share certain information as set forth above and allow third parties to collect information about your activity, for example through cookies, as also explained above. You can control these cookies through browser settings and other controls offered by third parties (like Google or Facebook, for example).

California Privacy Rights

If you are a California resident, you may have certain rights. California law may permit you to request that we:

  • Provide you the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we shared personal information.
  • Provide access to and/or a copy of certain information we hold about you.
  • Delete certain information we have about you.

You also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights. Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide the Services to you and for compliance with applicable law. If you ask us to delete certain information, you may no longer be able to access or use the Services.

Under California’s “Shine the Light” law, California residents who provide personal information in connection with purchasing products or services from us may request, once per year, that we disclose the identity of any third parties with whom we have shared personal information for the third parties’ direct marketing purposes within the previous calendar year, along with the type of personal information disclosed. Such a request may be made by visiting our Contact page and selecting “Privacy Questions” under “What Would You Like to Talk to Us About?” In response to such a request, we will provide information as required by the California law for the previous calendar year concerning such other businesses and the categories of personal information, if any, that we have shared with them.

You will be required to verify your identity before we fulfill your request. To do so, you may need to provide your name, address, e-mail address, and/or phone number or to verify certain account information like your username or recent purchase/selling history. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf. You will still need to verify your identity directly with us.
